The Santa Barbara Trust for Historic Preservation's Rules Governing the Tapas, Vino y Arte 2007 Raffle (8-Day, 7-Night Trip for 2 to Spain)

These official rules govern the conduct of the raffle. By purchasing a raffle ticket, you agree to be bound by these official rules and the decisions of the SANTA BARBARA TRUST FOR HISTORIC PRESERVATION which shall be final. State of California Non-Profit Raffle Registration #RF-0000074.

ELIGIBILITY: Raffle ticket buyers must be 18 years of age or older. No employees of SANTA BARBARA TRUST FOR HISTORIC PRESERVATION or those living in their households are eligible to participate. The raffle is void where prohibited by law.

ENTRY: A maximum of 10,000 tickets will be sold. The IRS has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts, and consequently do not qualify as deductible charitable contributions. Raffle participants and prizewinners agree that SANTA BARBARA TRUST FOR HISTORIC PRESERVATION will be able to use their name and/or likenesses for media purposes including but not limited to, television, radio, web/internet and print. The list of prizewinners will be published on SANTA BARBARA TRUST FOR HISTORIC PRESERVATION'S website (www.sbthp.org). EACH CONTESTENT, WHETHER A SINGLE TICKET PURCHASER, OR A "GIFT" NAMED TICKET HOLDER, BY PURCHASING A TICKET ACKNOWLEDGES AND WARRANTS THAT HE/SHE HAS READ AND UNDERSTOOD THESE RULES, AND WILL BE BOUND BY THEM.

TICKET ORDERS: Tickets are $10.00 each, 3 for $25.00, or 15 for $100.00 and may be purchased solely from SANTA BARBARA TRUST FOR HISTORIC PRESERVATION. You may buy as many tickets as you wish, subject to availability. To purchase tickets: visit El Presidio de Santa Barbara State Historic Park (123 E. Canon Perdido St, Santa Barbara, CA 93101) or order by phone at (805) 965-0093. Tickets may not be purchased via voicemail. Phoned or mailed raffle ticket orders accompanied by valid credit card (MasterCard, Visa) numbers, expiration dates and cardholder signature or check/money order will be processed in the approximate order in which they are received and verified. Make checks/money orders payable to SANTA BARBARA TRUST FOR HISTORIC PRESERVATION (SBTHP). SANTA BARBARA TRUST FOR HISTORIC PRESERVATION will reject any raffle ticket order if credit card payment is not honored or the check is rejected for any reason. The ticket receipt(s) will be mailed to the number 1 ticket holder.

REFUNDS: All raffle ticket sales are final. Tickets may not be changed, sold or transferred by the purchasing party or anyone else. No refunds will be made except under the following circumstances: any ticket order with payment received after 10,000 tickets have been sold or after the deadline of SEPTEMBER 29, 2007, will be returned. No other refunds are available. SANTA BARBARA TRUST FOR HISTORIC PRESERVATION assumes no responsibility for lost, late, misdirected or non-delivered mail or fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadlines. A raffle participant's sole and exclusive remedy for SANTA BARBARA TRUST FOR HISTORIC PRESERVATION's breach shall be limited to the return of the purchase price paid for his or her raffle ticket(s). In no event shall SANTA BARBARA TRUST FOR HISTORIC PRESERVATION, its directors, officers, employees, agents or representatives be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages.

PRIZE: Winner will be called by name and verified by matching the ticket with information in SANTA BARBARA TRUST FOR HISTORIC PRESREVATION records including the ticket order form. Prizes are subject to tax withholding in accordance with applicable law. If any winner cannot be located after reasonable attempts to do so by SANTA BARBARA TRUST FOR HISTORIC PRESERVATION, or if any winner is deemed to be ineligible or does not otherwise claim his or her prize by 5:00 p.m. on the day that is 90 calendar days following the Grand Prize Drawing, such winner will be deemed to have forfeited his or her prize. SANTA BARBARA TRUST FOR HISTORIC PRESERVATION, its directors, officers, employees, agents and representatives are not responsible for any injuries, losses or damages of any kind arising in connection with or as a result of a winner's acceptance or use of any prize. Each prize winner agrees to indemnify, defend and hold SANTA BARBARA TRUST FOR HISTORIC PRESERVATION, its directors, officers, employees, agents and representatives harmless from any and all losses, damages, rights, claims and actions of any kind arising in connection with or as a result of such winner's acceptance or use of any prize. SANTA BARBARA TRUST FOR HISTORIC PRESERVATION is not providing legal or tax advice to any contestant or winner, and all contestants and winners must consult professional legal and tax advisers prior to ticket purchase, and by purchasing a ticket acknowledge and warrants eligibility. Prize is not redeemable for cash. Travel arrangements must be made with Santa Barbara Travel Bureau. Specific itinerary and departure dates subject to availability. Prize includes round-trip airfare from Los Angeles, CA to Madrid, Spain via London, England. Any changes or additions to this route is the sole responsibility of the winner. Prize includes airfare and hotel accommodations only; taxes, fees, meals, admissions, transfers, and incidental expenses are the sole responsibility of the winner. Prize includes seven (7) nights accommodation only; any extension is the sole responsibility of the winner.
